Selectmen Meeting Minutes 05/17/04
The Board of Selectmen held a regular meeting on May 17, 2004 in the Board Room at the C. H. Booth Library, Main Street, Newtown, CT.  First Selectman Rosenthal called the meeting to order at 7:30 pm.

PRESENT:        First Selectman Herbert Rosenthal, Selectman Joseph Bojnowski, Selectman William Brimmer

ALSO PRESENT:  Town Engineer Ron Bolmer, four members of public, one member of press

VOTER PARTICIPATION:  Ms. Ruby Johnson, 16 Chestnut Hill Road,  distributed additional page to handout she had at last meeting, showing renovation of Newtown Hall by the town.
        Barbara O’Connor, Little Brook Lane, saw that more towns are developing ordinances to control use of ATV’s and dirt bikes.   First Selectman Rosenthal advised that at the last meeting, the Board of Selectmen voted to recommend to the Council that these vehicles be banned from town property.

COMMUNICATIONS:  First Selectman Rosenthal reported that the Legislature passed a change to the revaluation schedules.  This will give relief to towns scheduled for reval in 2003, 2004 and 2005, allowing them to wait until 2006 and then after that require revals every five years instead of four years.  Newtown is scheduled for reval again in 2006.  If all towns are going to reval in 2006, there won’t be enough reval firms to perform the work.  
        The Board members expressed their condolences to State Representative Julia Wasserman for the recent fire at her home.  First Selectman Rosenthal also commended all of the firefighters from Newtown and surrounding towns.  

ADD TO AGENDA:  First Selectman Rosenthal noted that the Special Town Meeting scheduled for earlier this evening was not held.  The legal notice was not submitted to the newspaper in time.  We will need to rescheduled.  Selectman Brimmer moved to add Call of Special Town Meeting to the agenda.  Motion seconded and unanimously carried.

ACCEPTANCE OF MINUTES:  Upon motion by Selectman Bojnowski, the minutes of the 5/3/04 meeting were unanimously accepted as presented.

UNFINISHED  BUSINESS

Road & Drainage Agreement – Bryan Lane, R&G Riverview LLC
Town Engineer Ron Bolmer did not receive any further information from developer.

Road & Drainage Work Agreement – Pepperidge Road, David French & Sons Builders
Mr. Charles Spath was present.   The developer, David French, is proposing to  provide the machine, operators and labor necessary to install a drainage system and to supply and install pavement patching if the Town aggress to furnish the pipe, catch basins and pipe bedding materials for the drainage improvements.  Mr. Spath states that the cost for the drainage improvements would be about $41,080 so by doing this now, the Town will save approximately $28,799 in drainage improvements for Pepperide Road.  Mr. Bolmer pointed out that this road is not in this year’s budget.  Mr. Rosenthal believes that the developer should supply materials and labor.  Mr. Spath will talk to Mr. French and come back to this Board.



UCONN Survey -  Fairfield Hills
This was discussed at the last meeting.  Selectman Brimmer stated that he has given this a lot of thought.  He still has an issue about cost, however, he thinks there is enough confusion around Fairfield Hills that we need to zero in on what the feeling is now.  After the presentation by Mr. McGloin of the UCONN Center for Survey Research and Analysis, he was very impressed with the integrity of the survey they would perform.
        Selectman Bojnowski moved to authorize the First Selectman to sign the agreement with the UCONN Center for Survey Research and Analysis for a survey.  Motion seconded and unanimously carried.

NEW BUSINESS

Call of Special Town Meeting
Selectman Brimmer moved to call a Special Town Meeting on Monday, June 7, 2004 at 7:15 p.m. as outlined on NOTICE OF SPECIAL TOWN MEETING (attached).  Motion seconded and unanimously carried.

Driveway Bond Releases/Extensions
Selectman Brimmer moved to release three (3) driveway bonds as outlined on attachment.  Motion seconded and unanimously carried.
        Selectman Brojnowski moved to approve a six month extension for two driveway bonds as outlined on attachment.  Motion seconded and unanimously carried.

Appointments
None at this time.

Legal Matters
None at this time.

ANNOUNCEMENTS:  First Selectman Rosenthal advised that he met today with Mr. Nuclo regarding the Fairfield Hills property.  We are down to one significant issue.  He is reluctant to expose the town to unlimited liability for how inground contamination is remediated.  We would need a permit to discharge to Deep Brook.  He does not want to agree that the town would take on that liability.  The Remedial Action Plan was submitted to DEP months ago and now this comes up.

Having no further business, the meeting was adjourned at 8:20 p.m.
